The plaintiffs, Martin Richard Israel and Tammy Lee Bannon Israel, were a brother and sister related to each other only by adoption. They were not related by blood. Martin’s natural father married Tammy’s natural mother when Martin was 18 and living in another state, and Tammy was 13. Two years later, Martin’s father adopted Tammy. As adults, the plaintiffs desired to marry in Colorado, but the Jefferson County Clerk denied them a marriage license. The denial was based on Colorado Uniform Marriage Act § 14-2-110(1)(b), which prohibited marriage between a brother and sister, “whether the relationship is by the half or the whole blood or by adoption.” The plaintiffs’ parents both filed affidavits supporting the proposed marriage. The plaintiffs filed a complaint for declaratory relief, and the district court held that the portion of the statute prohibiting marriage between adoptive siblings was an unconstitutional violation of equal protection.
