Tommy Hilfiger, U.S.A., Inc. (Hilfiger), a major apparel company, designed a nautical-themed clothing line featuring the “STAR CLASS” mark and a red star, intending to evoke “authentic details from the sport of competitive sailing.” Before launching the line, Hilfiger’s attorneys conducted a trademark search limited to federally registered marks in the clothing classification. Despite counsel’s advice to conduct a “full trademark search,” Hilfiger proceeded without one.
