Plaintiff Inman entered into a written employment contract with Defendant, Clyde Hall Drilling Company. The contract contained a clause requiring an employee to provide written notice of any claim within thirty days of its accrual. The clause explicitly stated that compliance was a “condition precedent to any recovery” and that no lawsuit could be filed until six months after such notice was given. The Company terminated Inman’s employment on March 24, 1960. On April 5, 1960, within the thirty-day period, Inman filed a lawsuit for breach of contract, serving the complaint on the Company on April 14. Inman did not provide a separate written notice as stipulated in the contract. In a deposition, Inman admitted he had read the contract and was familiar with its terms, but believed that filing the lawsuit itself constituted the required notice. The trial court granted summary judgment in favor of the Company, finding that Inman’s failure to comply with the condition precedent barred his action.
