Sather immediately deposited the funds into his operating account and spent them, believing he had earned the fee upon receipt. After Sather was suspended for an unrelated matter, Perez discharged him and requested an accounting. Sather acknowledged he owed Perez $13,076.36 in unearned fees but took five months to provide a full refund because he had already spent the money.
