tl;dr: An attorney in a divorce case revealed his client’s confidential suspicions of child abuse to opposing counsel against her express wishes. The court affirmed a public reprimand, finding the disclosure was a knowing violation that caused the client cognizable emotional injury.

Legal Significance: This case clarifies that revealing a client confidence, even without malicious intent, constitutes a “knowing” violation warranting public reprimand if it causes client injury, such as emotional distress. It underscores the sanctity of the duty of confidentiality.

Case Facts & Court Holding

Key Facts & Case Background

Attorney Thomas Pressly represented a client in a contentious divorce involving allegations of the husband’s alcoholism and abuse. The client later confidentially informed Pressly that she suspected her husband was sexually abusing their daughter, based on a counselor’s observations. She explicitly instructed Pressly not to disclose these suspicions to her husband’s lawyer. Despite this directive, when opposing counsel questioned the basis for the client’s request for supervised visitation, Pressly revealed the confidential information. He naively asked opposing counsel not to relay the information to the husband, but counsel immediately did so. The disclosure caused the client significant emotional distress, fear, and anxiety, leading her to discharge Pressly. The Professional Conduct Board found Pressly violated Disciplinary Rule (DR) 4-101(B)(1) by knowingly revealing a client confidence. The Board recommended a public reprimand, which Pressly appealed, arguing his conduct was merely negligent and caused no significant injury.
