Colonel Vance Spath, a military judge, presided over Abd Al-Rahim Al-Nashiri’s capital military commission proceedings. In November 2015, Spath applied for an immigration judge position within the U.S. Department of Justice (DOJ), the same department involved in prosecuting Al-Nashiri. Spath highlighted his role in Al-Nashiri’s high-profile case in his job application. He did not disclose this application or subsequent employment discussions to Al-Nashiri or his defense counsel.
