Francis E. Maher, an attorney, suffered a stroke resulting in hemiplegia and aphasia. His son, Francis E. Maher, Jr. (appellant), initially sought a conservator under former Mental Hygiene Law article 77. After Maher’s condition improved and he executed a power of attorney in favor of the appellant, the appellant sought to withdraw the petition. However, alleging a subsequent deterioration in Maher’s condition and Maher’s intention to marry, the appellant revived the proceeding. Maher then revoked the power of attorney to his son and executed a new one in favor of Irwin F. Simon, a long-time associate. Maher also married Ms. Helen Kelly. The proceeding was converted to one for the appointment of a guardian for property management under the newly enacted Mental Hygiene Law article 81. At the hearing, testimony indicated Maher had functional limitations in speaking and writing but was improving and understood his affairs. He had arranged for assistance through the power of attorney to Simon and by adding his wife as a signatory on bank accounts. The trial court found the appellant failed to prove by clear and convincing evidence that Maher was incapacitated and that a guardian was necessary.
