The Testator’s father, Melvin Hyman, died leaving his wife, Maintzie, a life estate in certain securities and a vested remainder interest to his son (“Testator”). The father’s will specified the remainder vested immediately upon his death. Years later, the Testator executed his own will shortly before a high-risk surgery. Article Three of his will devised “any and all property which I may receive by reason of inheritance from my mother’s [Maintzie’s] estate” to a trust for his three children. The residuary clause left the remainder of his estate to his second wife, Sara Hyman. The Testator predeceased his mother. Upon Maintzie’s death, her life estate terminated, and the remainder interest became possessory. The Testator’s son (“Appellant”) sued, arguing the securities should pass to the children’s trust under Article Three. Appellant sought to introduce testimony from the Testator’s sister that the Testator colloquially referred to the remainder interest as property that would come from his “mother’s estate.” The trial court found the will unambiguous and excluded this extrinsic evidence.
