After populations in the Western Great Lakes (WGL) region recovered, the Fish and Wildlife Service (FWS) engaged in multiple attempts to delist them. In 2011, the FWS issued a final rule that simultaneously (1) designated a Western Great Lakes Distinct Population Segment (DPS) of gray wolves, carving it out from the broader, already-listed species, and (2) removed this newly created DPS from the ESA’s protections. The FWS justified its action based on a Solicitor’s Opinion concluding the ESA allows for such a ‘carve-out and delist’ procedure. In its analysis, the FWS interpreted the ESA term “range” to mean the species’ “current range,” not its historical range. The Humane Society challenged the rule, arguing the FWS lacked the statutory authority to designate a DPS for the sole purpose of delisting it and that the agency’s decision-making process was flawed under the Administrative Procedure Act (APA).
