Serenus Hoffner, a public school principal, was notified by the Bismarck Public School District that it was contemplating the nonrenewal of his employment contract. The reason given was his “inability to effectively perform… including unsatisfactory working relationships with the staff.” Hoffner’s employment was governed by N.D.C.C. § 15-47-38(5), which requires that reasons for nonrenewal be “drawn from specific and documented findings arising from formal reviews conducted by the board.” The parties disputed the meaning of “formal reviews.” Hoffner contended it referred exclusively to his annual written evaluations, while the District argued it meant the nonrenewal hearing itself. The record showed a history of documented concerns regarding Hoffner’s interpersonal and management style. A 1995 evaluation led to a “Plan for Personal Growth” to address communication and trust issues, and a 1996 memo documented similar ongoing problems.
