Eric B. Herr, a college student, died of acute ethanol poisoning on January 17, 1984, the day of his 21st birthday. On the preceding day, January 16th, his roommates and an acquaintance (Defendants) purchased alcohol to celebrate his impending birthday. All contributed money for the purchase. That evening, the defendants and others gathered at Herr’s apartment. One defendant gave Herr a bottle of whiskey as a birthday present. Herr consumed most of the bottle himself in two sustained gulps before midnight. He was later found dead in his bedroom. His parents (Plaintiffs) sued the defendants, alleging battery and negligence for furnishing alcohol and failing to render aid. The trial court granted summary judgment for the defendants, finding that under the common law, Herr was legally an adult on January 16th, thus precluding social host liability under the rule of Klein v. Raysinger.
