Richard Bennett, an employee of Culligan Water Conditioning (Culligan), stole an ATM card belonging to Donald and Luella Buell while performing services at their residence. Bennett subsequently used the card to misappropriate approximately $10,000 from the Buells’ account with Heritage Bank (Heritage). Heritage recredited all but $50 of the Buells’ account, consistent with federal law limiting consumer liability for unauthorized electronic fund transfers. Heritage then sued Culligan, asserting theories of respondeat superior (later abandoned on appeal) and negligent hiring.
