Defendant Charles Burns, while intoxicated and engaging in a “road rage” pursuit of another car, ran a red light at high speed and collided with a vehicle driven by the plaintiff, Marjorie Hendrix. Hendrix sustained significant physical and emotional injuries. Burns had a history of DUI convictions, which was known to his wife, the vehicle’s owner. Before trial, Burns conceded liability for negligence, and his wife conceded liability for negligent entrustment, leaving only the issue of damages for the jury. The trial court granted summary judgment for Burns on Hendrix’s separate battery claim, finding insufficient evidence of intent. The court also granted motions in limine to prevent the jury from hearing evidence of Burns’s intoxication, road rage, prior convictions, or his attempt to flee the scene.
