Henry Tyler Construction Corporation (HTCC) contracted with Costa and Head (Atrium), Ltd., a limited partnership, for construction work. Atrium failed to pay the full amount due. HTCC sued Atrium and its tiered general partners, ultimately reaching individual general partners Beverly P. Head, Jr., and James R. Forman, Jr. Atrium’s general partner was Costa and Head (Birmingham One), Ltd., another limited partnership, whose general partner was Costa and Head Land Company, a general partnership.
