Kimberly Hall (Appellant) and Roberto Maal (Appellee) planned a wedding for March 2, 2002. They arranged for a church, minister, invitations, and attended pre-marital counseling. The week of the wedding, Dr. Maal informed Ms. Hall they could not obtain a marriage license because they had not finalized a pre-nuptial agreement. Despite knowing they lacked a license, Dr. Maal persuaded Ms. Hall to proceed with the wedding ceremony. They participated in a full, public religious ceremony attended by family and friends. For several years afterward, they held themselves out as a married couple, had two children, and were referred to as husband and wife on their home mortgage. However, they continued to file separate tax returns. A year after the ceremony, they applied for and received a marriage license but never had it solemnized or returned to the clerk for recording. In 2006, Ms. Hall filed for dissolution of marriage. Dr. Maal denied the existence of a valid marriage. The trial court agreed, finding no valid marital relationship existed.
