A creditor, Crouch, obtained a judgment against Brookshire for approximately $2,000. To satisfy the judgment, the sheriff levied on Brookshire’s 322-acre farm and advertised its sale. The total debt with costs was $2,308.16. Before the sale, the sheriff also received a second, unadvertised execution for a separate $17,000 judgment against Brookshire. The farm’s net value was estimated between $46,000 and $86,000. Brookshire formally requested in writing that the sheriff sell only a specific 40-acre parcel, which was unencumbered and worth more than enough to satisfy the advertised Crouch judgment. The sheriff ignored this request and the statutory duty to divide property, instead selling the entire 322-acre farm as a single tract. Griggs purchased the farm for $20,600. The proceeds were used to satisfy both the advertised Crouch judgment and the unadvertised $17,000 judgment. Griggs sued for ejectment, and Brookshire counterclaimed in equity to set aside the sheriff’s sale and deed.
