Terrance Graham, at age 16, participated in an attempted restaurant robbery where an accomplice struck the manager with a metal bar. He pleaded guilty to armed burglary and was sentenced to probation. Less than six months later, while still 17, he participated in a home invasion robbery, leading to a probation violation. The trial court revoked his probation and, finding him incorrigible, sentenced him to life in prison for the original armed burglary charge. Under Florida law, this sentence carried no possibility of parole. Graham was a juvenile when he committed the underlying offense, which was a nonhomicide crime. His sentence was the maximum authorized by law and exceeded the prosecutor’s recommendation. The sentence meant Graham would die in prison without any opportunity for release based on rehabilitation or demonstrated maturity.
