The Empire State Development Corporation (ESDC), a state agency, sought to use its eminent domain power to acquire private properties for the “Atlantic Yards” project, a 22-acre mixed-use development in Brooklyn proposed by a private developer, Forest City Ratner Companies (FCRC). The project included a professional basketball arena, commercial and residential towers, and infrastructure improvements. While a portion of the project area was within a previously designated urban renewal area, several blocks, including petitioners’ properties, were not. To justify the taking of these properties, ESDC commissioned a study, funded by FCRC, which concluded the area was “substandard and insanitary,” or “blighted.” The study cited conditions such as underutilization of lots, irregular lot sizes, and some building deterioration.
