Frank Gaylord sculpted 19 stainless steel soldier statues, known as “The Column,” as the central feature of the Korean War Veterans Memorial. Gaylord registered the copyright for the sculptures as the sole author. Years later, photographer John Alli captured an image of the snow-covered sculptures. The United States Postal Service subsequently paid Alli $1,500 to use his photograph on a 37-cent commemorative stamp. The stamp, which depicted 14 of the 19 sculptures, generated over $17 million in revenue for the Postal Service from the sale of approximately 48 million stamps and related retail goods. The Postal Service did not seek or obtain permission from Gaylord. Gaylord sued the United States for copyright infringement. The government asserted defenses of fair use, joint authorship based on the input of various government committees, and an exemption under the Architectural Works Copyright Protection Act (AWCPA). The Court of Federal Claims found for the government on fair use grounds, prompting Gaylord’s appeal.
