Rivers Construction Co. hired John Gates, a Canadian citizen, to perform public relations work in Alaska. Both parties knew Gates was not authorized to work in the United States. They agreed that Gates’s salary would be held in trust and paid to him only after he secured a visa for permanent residency. Gates performed services for over a year, but the company terminated his employment shortly before he obtained permanent resident status on December 11, 1970. When Rivers Construction refused to pay the accrued salary, Gates sued for breach of contract. The defendant argued the contract was illegal and therefore unenforceable because it violated federal immigration law, specifically 8 U.S.C. § 1182(a)(14), which makes aliens seeking to perform labor without proper certification ineligible for visas. The trial court agreed with the defendant and dismissed the case, holding the contract was void as against public policy.
