Case Brief Summary & Legal Analysis

4 min read

tl;dr: The court affirmed that nearly identical wills were contractual, based on extrinsic evidence of an oral agreement, rendering a subsequent revoking will ineffective regarding certain beneficiaries and justifying a constructive trust.

Legal Significance: This case affirms that extrinsic evidence, including a scrivener’s testimony, is admissible to prove wills are contractual, even without explicit contractual language, and that a constructive trust is an appropriate remedy for breach.

Case Facts & Court Holding

Key Facts & Case Background

John Humble and Sarah Puffinbarger, spouses in a blended family, executed nearly identical wills in 1984, prepared by attorney Timothy Fielder. Each will bequeathed the estate to the surviving spouse “absolutely,” and then, if the other spouse predeceased or they died simultaneously, into sevenths: one-seventh to each of their six combined surviving children and one-seventh to the children of Sarah’s predeceased son. John died in 1984, and his estate passed to Sarah. In 1993, Sarah executed a new will, revoking her 1984 will and disinheriting John’s children and her predeceased son’s children, leaving her estate only to her two daughters. Fielder testified that John and Sarah had an oral agreement that their 1984 wills were contractual, intending to bind the survivor regarding the deceased spouse’s children but allowing the survivor to alter shares for their own children. He informed Sarah of this agreement before she executed the 1993 will. John’s children sued, alleging the 1984 wills were contractual and seeking a constructive trust.

Court Holding & Legal Precedent
