Respondents, Susan and Walter Cohn, sued petitioner G. D. Searle & Co., a foreign corporation, in New Jersey for injuries allegedly caused by an oral contraceptive manufactured by Searle. The suit was filed eleven years after the injury. Searle, served under New Jersey’s long-arm rule, moved for summary judgment based on New Jersey’s two-year statute of limitations. Respondents invoked N.J. Stat. Ann. § 2A:14-22, which tolls the limitation period for actions against foreign corporations not “represented” in New Jersey by a person upon whom process may be served. The New Jersey Supreme Court, in Velmohos v. Maren Engineering Corp., subsequently upheld the statute, finding rational bases for its continued application.
