F. W. Woolworth Company (Defendant) organized a promotional “ping-pong ball drop” at its store to attract customers. The event involved dropping 768 ping-pong balls, each containing a prize certificate, from an airplane into the store’s parking lot. Extensive advertising drew a crowd estimated at 4,500 people. The pilot hired for the drop warned the defendant that he could not control where the balls would fall. Lona Pearl Kirby (Plaintiff), a 70-year-old woman, went to the parking lot to watch the event. During the third drop, the crowd rushed to catch the falling balls, and in the ensuing chaos, someone knocked the plaintiff down and others ran over her, causing serious injuries, including a broken hip. There was evidence that other patrons had also been knocked down during the previous two drops. Plaintiff sued, alleging the defendant was negligent in failing to control the crowd it had amassed. The jury returned a verdict for the plaintiff.
