Plaintiffs Charles Freeman and Rosalyn Brown owned two vacant, dilapidated apartment buildings in Dallas. City inspectors cited the properties for numerous violations of the Urban Rehabilitation Standards Code. The matter was referred to the Urban Rehabilitation Standards Board (URSB), a quasi-judicial body composed of private citizens. The URSB provided the owners with notice and conducted hearings, at which Freeman appeared and presented evidence. The URSB determined the buildings were “urban nuisances” and, after a rehearing, affirmed its order to demolish them. The demolition notice informed the owners of their right to appeal the URSB’s decision to a state district court within twenty days. The owners did not appeal. After the owners failed to demolish the buildings themselves, the City hired a contractor and had the structures razed without first obtaining a judicial warrant. The owners subsequently filed a § 1983 suit, alleging the warrantless demolition constituted an unreasonable seizure in violation of the Fourth Amendment. The district court granted summary judgment for the plaintiffs on this claim. A Fifth Circuit panel affirmed, but the court granted a rehearing en banc.
