Case Brief Summary & Legal Analysis

4 min read

tl;dr: The court held that life insurance proceeds were not includible in decedent’s estate where his powers over the policies as trustee were acquired from his deceased wife, not retained by him, and could not be exercised for his personal economic benefit.

Legal Significance: This case clarifies that fiduciary powers over life insurance policies, acquired from another and not exercisable for personal benefit, do not constitute “incidents of ownership” under § 2042(2) of the Internal Revenue Code.

Case Facts & Court Holding

Key Facts & Case Background

In 1961, Hector Skifter assigned all his interest in nine life insurance policies on his life to his wife, Naomi, retaining no interest or power over them. Naomi predeceased Skifter, leaving a will that placed her residuary estate, including these policies, into a trust. The trust income was payable to their daughter for life, with remainder to others. Naomi appointed Skifter as trustee, granting him broad discretionary powers, including the power to pay over the entire principal to the current income beneficiary, even if it terminated the trust, and broad management powers. Skifter could not, however, exercise these powers for his own economic benefit or alter the beneficiaries. Upon Skifter’s death in 1964, the Commissioner of Internal Revenue (C.I.R.) contended that Skifter’s trustee powers constituted “incidents of ownership” under § 2042(2), requiring inclusion of the policy proceeds in his gross estate. The Tax Court ruled in favor of the estate.

Court Holding & Legal Precedent

Issue: Do broad fiduciary powers over life insurance policies, held by a decedent as trustee of a trust created by another, where such powers were not retained by the decedent and cannot be exercised for his personal economic benefit, constitute “incidents of ownership” under § 2042(2) of the Internal Revenue Code, thereby requiring inclusion of the policy proceeds in the decedent’s gross estate?
