Stanley Pinkham consumed a hot turkey sandwich made with Cargill’s boneless turkey product. Immediately thereafter, he experienced severe abdominal pain and was diagnosed with an esophageal perforation. During an endoscopy, Dr. Stern discovered a small food bolus near the perforation containing fragments of bony or cartilaginous material, measuring one to two millimeters. Dr. Stern opined the injury was a “perforation secondary to a foreign body.” Additional evidence indicated that kitchen staff at the restaurant occasionally found pieces of bone in Cargill’s “boneless” turkey product. Pinkham’s estate filed a complaint against Cargill under Maine’s strict liability statute, 14 M.R.S. § 221, alleging the turkey was defective. The trial court granted summary judgment for Cargill, reasoning that bone is natural to turkey and a consumer would reasonably expect small fragments in a “boneless” turkey product, thus it was not defective as a matter of law.
