Equitable Life Assurance Society held a mortgage on the Olsons’ ranch land and initiated a foreclosure action upon their default. The court ordered a judicial foreclosure sale to be conducted by the county sheriff. The day before the scheduled sale, First National Bank (FNB), a junior mortgagee, paid Equitable’s debt in full in exchange for an assignment of Equitable’s mortgage. On the morning of the sale, Equitable’s attorney attempted to contact the sheriff to cancel the sale but could not get through. The sale commenced at 11:05 a.m. At 11:15 a.m., with bidding at $1,800,000, Equitable’s attorney reached the sheriff’s office by phone and instructed the deputy to cancel the sale because the underlying judgment had been satisfied and assigned. The sheriff paused the auction, spoke with the attorney, but then, after consulting with the state’s attorney and at the bidders’ request, continued the sale. The property was sold to Carl Mathews for $1,810,000. The trial court confirmed the sale, holding it was valid. Equitable, FNB, and the Olsons appealed.
