The plaintiff, Dyer, filed a complaint alleging two counts of slander. In one count, he alleged that defendant MacDougall told a third party, Almirall, that a letter Dyer wrote was a “blackmailing letter.” In another count, he alleged MacDougall’s wife made a similar statement to another third party, Mrs. Hope. The defendants moved for summary judgment under Federal Rule of Civil Procedure 56. In support of their motion, they submitted affidavits from themselves, Almirall, and a deposition from Mrs. Hope. All four individuals, who were the only people with direct knowledge of the alleged conversations, unequivocally denied that the slanderous statements were ever made. The plaintiff offered no admissible evidence to contradict these denials; his own affidavits contained inadmissible hearsay. The district court offered the plaintiff the opportunity to depose the defendants and their witnesses, but the plaintiff declined. The district court granted summary judgment for the defendants, finding that the plaintiff would have no evidence to present at trial to support his claims.
