Stephen Gillies (Tenant) leased commercial space from Cleo Dvoracek (Landlord). The lease provided an option to renew for two years if the tenant gave written notice at least 60 days before expiration. The parties occupied adjacent properties, and Gillies had an established practice of hand-delivering his rent checks to Dvoracek or her employees at her business next door. Dvoracek never objected to this practice. Gillies testified that he delivered a timely written renewal notice to an employee at Dvoracek’s business, asking the employee to ensure Dvoracek received it. Dvoracek denied ever receiving the notice and, after the notice period lapsed, informed Gillies the lease would terminate. She subsequently refused his rent payment for the next month and initiated an unlawful detainer action. The trial court granted a directed verdict for Dvoracek, finding as a matter of law that her employees were not her agents for the purpose of receiving a lease renewal notice.
