Appellants, well-known surfers, were photographed at a 1965 surf championship. Decades later, Abercrombie & Fitch (A&F), a clothing retailer, purchased this photograph. Without Appellants’ permission, A&F published the photograph, identifying Appellants by name, in its Spring 1999 catalog, the “Abercrombie and Fitch Quarterly.” The catalog, A&F’s primary advertising vehicle, featured a surfing theme. The photograph appeared in a section titled “Surf Nekkid,” near an article on surfing history and immediately preceding pages advertising “Final Heat Tees,” which were t-shirts identical to those worn by Appellants in the photograph. A&F’s CEO decided to use the photograph and create the t-shirts. Appellants alleged misappropriation of name and likeness under California common and statutory law, Lanham Act violations for false endorsement, negligence, and defamation. The district court granted summary judgment for A&F.
