Robert Kowell invested in J.T. Wallenbrock & Associates, which was later revealed by the SEC to be a massive Ponzi scheme. Kowell, acting in good faith, received payments from Wallenbrock that exceeded his principal investment, making him a “net winner.” After the scheme collapsed, a court-appointed receiver, James Donell, was tasked with recovering assets for distribution to all defrauded investors. The Receiver sued Kowell under California’s Uniform Fraudulent Transfer Act (UFTA) to recover the profits he had received. Kowell argued that as an innocent victim, he should not have to return his gains, that the payments were for reasonably equivalent value, and that any liability should be offset by income taxes he paid on the profits.
