To finance the purchase, David Evans alone executed a mortgage and promissory note with the lender, Argent Mortgage Company (later held by Deutsche Bank). It was stipulated that Mary Anne Evans had knowledge of and consented to the mortgage, and that the loan proceeds were used to acquire their shared residence. The mortgage was properly recorded. Subsequently, the Evanses filed for Chapter 13 bankruptcy. The bankruptcy trustee, invoking the “strong-arm” powers of 11 U.S.C. § 544(a), sought to avoid the mortgage. The trustee argued that because Mary Anne, a co-owner in the tenancy by the entirety, did not sign the mortgage, the conveyance was invalid under the Pennsylvania Statute of Frauds.
