Plaintiffs were driving their Ford automobile across a county-maintained bridge on a rainy evening. The elevated wooden approach to the bridge featured a sharp right-angle turn. As they navigated this turn at a low speed, their car skidded, struck the outer railing, broke through it, and fell to the ground below, causing severe injuries. The plaintiffs, who were familiar with the bridge, alleged the county was negligent due to a combination of three factors: (1) the guardrail was insufficient and its support posts were partially decayed; (2) the bridge deck had a slight outward and downward slope at the curve, which they claimed contributed to the skid; and (3) wet dirt, recently scattered by county workers, made the surface unusually slippery. The county denied negligence. A jury found for the plaintiffs, and the county appealed the trial court’s denial of its motion for judgment notwithstanding the verdict.
