Case Brief Summary & Legal Analysis

4 min read

tl;dr: Developers reverse-engineered a video game’s online service to create a free alternative. The court found this violated the DMCA’s anti-circumvention rules and that the developers had contractually waived their right to reverse-engineer by agreeing to the game’s license agreement.

Legal Significance: Establishes that users can contractually waive statutory copyright exceptions, such as the DMCA’s interoperability defense. Upholds the enforceability of End User License Agreements (EULAs) that prohibit reverse engineering, finding such contract claims are not preempted by federal copyright law.

Case Facts & Court Holding

Key Facts & Case Background

Blizzard Entertainment (Plaintiff) developed popular computer games that included an exclusive online multiplayer service called Battle.net. To access Battle.net, a user’s legitimate copy of the game, authenticated by a unique CD Key, would perform a “secret handshake” with Blizzard’s servers. This process was a technological protection measure (TPM) to control access to the copyrighted online components of the game. All users were required to accept the terms of an End User License Agreement (EULA) and Terms of Use (TOU) before installing or playing online. These agreements expressly prohibited reverse engineering, decompiling, or creating derivative works. The defendants, a group of programmers, reverse-engineered Blizzard’s authentication protocol to create “bnetd.org,” a server emulator that mimicked Battle.net. They distributed this software for free, allowing users to play Blizzard’s games online without connecting to Battle.net. The bnetd.org emulator intentionally bypassed the CD Key verification process, which permitted users with unauthorized or pirated copies of the games to play online. Blizzard sued for, among other things, breach of contract and violations of the Digital Millennium Copyright Act (DMCA).

Court Holding & Legal Precedent

Issue: Can a software licensor enforce contractual prohibitions against reverse engineering found in an End User License Agreement, and do such prohibitions prevent a defendant from invoking the Digital Millennium Copyright Act’s interoperability exception as a defense to circumvention and trafficking claims?

Yes. The court affirmed summary judgment for Blizzard, holding that the defendants Lorem ipsum dolor sit amet, consectetur adipiscing elit, sed do eiusmod tempor incididunt ut labore et dolore magna aliqua.
