Respondent, Letta Farnsworth, alighted from petitioner’s streetcar into a designated safety zone at an intersection where the tracks made a sharp left turn. Farnsworth was unfamiliar with the route and unaware that the rear of the streetcar would swing outward (overhang) when making the turn. Eyewitness testimony indicated that the streetcar started “abruptly” and “rapidly for that intersection” almost instantaneously after Farnsworth stepped off, striking her before she had time to move. The operator was unaware the accident had occurred. Over the defendant’s objection, the trial court admitted Farnsworth’s testimony that on the same trip, just minutes before the accident, the operator had started the car hurriedly at three previous stops. The jury found the railway company negligent for failing to give Farnsworth an opportunity to get clear of the overhang and for failing to keep a proper lookout. The railway appealed, arguing there was no evidence of negligence and that the testimony regarding the operator’s prior conduct was inadmissible character evidence.
