B. T. Freeman’s will devised a farm to two of his daughters for life. Upon the death of the last life tenant, the remainder interest was to be divided among his eleven named children, “share and share alike.” The will included a gift-over provision stating that if any child predeceased the life tenants, their share would go to their issue. A subsequent, conflicting clause provided that if a child died without issue, their share would descend to the testator’s “children then living, share and share alike.” By the time the final life estate terminated in 1980, five of the testator’s children had died with issue, five had died without issue, and only one child, Delilah Stackley, remained alive. Stackley, the appellant, argued that the shares of the five children who died without issue should pass exclusively to the testator’s children who were alive at the time each childless heir died, which would primarily benefit her. The issue of the deceased children (appellees) contended that the shares should be distributed per stirpes among all family lines, including their own.
