John Coomer, a spectator at a Kansas City Royals baseball game, was struck in the eye by a foil-wrapped hotdog thrown by the team’s mascot, Sluggerrr. The incident occurred during a between-innings promotional segment called the “Hotdog Launch.” Coomer testified that he saw the mascot wind up for a behind-the-back throw but looked away at the scoreboard just before being hit. He subsequently suffered a detached retina and a traumatic cataract. Coomer sued the Royals for negligence. The team admitted vicarious liability for the mascot’s actions but asserted the affirmative defenses of assumption of the risk and comparative fault.
