Christine Claveloux was the only child of Anna McGloin. Following the death of McGloin’s husband, a physician found McGloin to be incompetent. Claveloux alleged that her cousin, Joseph Bacotti, subsequently exerted influence over the incompetent McGloin. Within weeks, McGloin closed bank accounts held jointly with her daughter and transferred the funds into new accounts held jointly with Bacotti. Bacotti also allegedly procured a new attorney for McGloin after her own attorney refused to alter her estate plan. McGloin then executed a new will and trust that disinherited Claveloux completely, naming Bacotti and a charity as the sole beneficiaries. Previously, Claveloux had been the secondary beneficiary of her mother’s estate. A court later appointed a plenary guardian for McGloin due to her deteriorating condition. While her mother was still alive, Claveloux filed suit against Bacotti, alleging intentional interference with her expectancy of an inheritance. The trial court dismissed the complaint for failure to state a cause of action.
