Defendant Charles Spingola, motivated by his religious belief that homosexuality is a sin, went to the Ohio Statehouse grounds with the intent to remove a rainbow flag. The flag, a symbol of gay pride, was owned by the organization Stonewall Columbus and was flying with permission from the state as part of a gay pride celebration. In front of protestors and supporters, Spingola climbed the flagpole, used a pocketknife to cut the flag down, and threw it to the ground.
