In 1967-68, the City of Bedford (Plaintiff) contracted with James Leffel & Co. (Defendant) for the design and installation of custom turbines. The installation was completed in April 1969. Immediately, one turbine performed poorly, and by 1972, the other was found to be deteriorating. From 1969 until March 1975, the defendant seller actively attempted to repair the turbines. During this period, the defendant sent numerous written communications encouraging the plaintiff to “bear with us,” acknowledging “a problem together,” and stating that the issues could be resolved through “proper adjustment” rather than litigation. The plaintiff filed suit for breach of contract and warranties in August 1974, more than four years after the 1969 installation.
