Respondents Eulala and Russel Shute, residents of Washington, purchased tickets for a cruise on a ship operated by petitioner Carnival Cruise Lines, Inc., a Florida-based corporation. The purchase was made through a Washington travel agent. The tickets, which were a standard form contract, contained a clause on one of the pages stipulating that all disputes arising under the contract must be litigated in a court located in Florida. The Shutes conceded they had notice of this provision. During the cruise in international waters, Mrs. Shute was injured and the Shutes filed a negligence suit against Carnival in the U.S. District Court for the Western District of Washington.
