Buchanan, a white individual, contracted to sell real property in Louisville, Kentucky, to Warley, a Black individual. The contract stipulated Warley was not obligated to complete the purchase if he could not legally occupy the property. A Louisville ordinance, enacted May 11, 1914, prohibited a Black person from moving into and occupying a residence on any block where a greater number of houses were occupied by white people, and vice versa for white persons in majority-Black blocks. The property in question was on a block with eight white-occupied residences and two Black-occupied residences. Warley cited the ordinance as preventing his lawful occupancy and refused to perform the contract. Buchanan sued for specific performance, arguing the ordinance violated the Fourteenth Amendment. The Kentucky Court of Appeals upheld the ordinance, whose stated purpose was to prevent racial conflict and promote public welfare. The case reached the Supreme Court on the question of the ordinance’s constitutionality.
