Leon Bruce and two confederates robbed a shoe store. Bruce, who was masked and armed with a handgun, ordered the store owner, Barry Tensor, to open the cash registers. After emptying one register and finding the second empty, Bruce demanded to know where the rest of the money was and then shot Tensor in the stomach. Tensor was hospitalized for five weeks but survived. Bruce was charged with multiple offenses, including attempted first-degree murder. At his second trial, a jury found him guilty of attempted first-degree felony murder, robbery with a deadly weapon, and handgun violations. The court merged the armed robbery conviction into the attempted felony murder conviction and sentenced Bruce to life imprisonment. The Court of Appeals of Maryland granted certiorari to determine whether attempted felony murder is a cognizable crime in the state.
