At the time of their marriage, the husband owned three real properties. During the marriage, marital funds, including rental income from the properties, were used to make mortgage payments and improvements on these assets. For example, on the “Ilhardt property,” marital funds reduced the mortgage principal by $1,176. The property was later sold, and the proceeds were used to pay off mortgages on the other properties. Similarly, marital funds were used to reduce the mortgage on the “Glen Cove property” and to pay for a new driveway on the “Wilmore property.” In the dissolution proceedings, the trial court classified all three properties, including their appreciation in value during the marriage, as the husband’s wholly nonmarital property. The wife appealed, arguing that the use of marital funds to reduce debt and make improvements created a marital interest in the properties.
