Plaintiffs sold real property to Defendants. A separate agreement provided that Plaintiffs would demolish an existing building on the property for $3,500 and were entitled to keep the salvaged materials. Plaintiffs specifically needed the plate glass and skylights from the old building, which were scarce and subject to governmental priority, to complete construction of a new building for a third party. In reliance on obtaining these materials, Plaintiffs designed the new building accordingly and did not order new ones, which would have caused a significant delay. Subsequently, Defendants’ own construction plans were delayed, and they notified Plaintiffs to halt the demolition, thereby repudiating the contract and forbidding them from entering the property. Despite the notice, Plaintiffs entered the land, demolished the building, took the needed salvage materials, and completed their other project. Plaintiffs then sued to recover the $3,500 contract price. Defendants filed a cross-complaint for trespass and waste.
