Case Brief Summary & Legal Analysis

4 min read

tl;dr: A nursing home forcibly confined an elderly patient for 51 days against his will and in violation of an admission agreement. The court affirmed liability for the intentional tort of false imprisonment and upheld an award of punitive damages for the home’s malicious conduct.

Legal Significance: This case illustrates the tort of false imprisonment, where direct restraint of physical liberty without legal justification is actionable. It also establishes that conduct showing an utter disregard for a person’s rights, such as confinement without a court order, can support an award of exemplary damages.

Case Facts & Court Holding

Key Facts & Case Background

Plaintiff Newman, a 67-year-old man, was admitted to the defendant’s nursing home by his nephew. The admission agreement expressly stated that the patient would “not be forced to remain in the nursing home against his will.” Three days after his admission, Newman decided to leave. The nursing home staff prevented his departure by denying him use of a telephone, locking up his clothing, and forcibly returning him when he attempted to walk out. He was then confined to a locked wing with mentally disturbed patients, alcoholics, and drug addicts. Over the next 51 days, Newman attempted to escape five or six times but was caught and forcibly returned on each occasion. As a punitive measure, staff strapped him into a “restraint chair” for hours. The nursing home held Newman without any court order or other legal justification. He eventually escaped and sued for false imprisonment. A jury found for Newman, awarding both actual and exemplary (punitive) damages.
