Plaintiff Berg, the tenant, operated a restaurant on premises leased from defendant Wiley, the landlord. The lease contained a clause allowing the landlord to retake possession if the tenant breached the lease conditions. A dispute arose over Berg’s remodeling without written consent and alleged health code violations. Wiley’s attorney sent a letter demanding Berg remedy several issues within two weeks or face eviction. On the final day of the deadline, Berg closed the restaurant and posted a sign reading “Closed for Remodeling.” That evening, a confrontation occurred, and police mediated an agreement to maintain the status quo over the weekend. On the following Monday, acting on his attorney’s advice, Wiley entered the premises in Berg’s absence, changed the locks, and re-let the property to a new tenant. Berg sued for wrongful eviction. The jury found that Berg had not abandoned or surrendered the premises and awarded her damages. The trial court found the lockout was wrongful as a matter of law, a finding Wiley appealed.
