Annette Beal purchased two adjoining parcels of land for a total of $230,000, financed by two separate promissory notes. A single deed of trust, covering both parcels, secured both notes. The deed contained a cross-default provision and gave the trustee discretion to sell the parcels “either as a whole or in separate parcels.” Beal fully paid off one of the two notes. Later, she defaulted on the second note, with a remaining balance of only $26,780.81. The trustee initiated a non-judicial foreclosure on both parcels to satisfy the remaining debt. At the foreclosure sale, the appellants formed a partnership on-site and were the sole bidders, purchasing both parcels for $26,781.81—one dollar over the outstanding debt. This sale price represented less than 15% of the property’s fair market value, which the trial court determined was best indicated by the original combined purchase price. Beal sued to set aside the sale. The trial court found the sale voidable, and the purchasers appealed.
