Robert Barnett, a customer service agent for U.S. Air for ten years, suffered a disabling back injury while working in a cargo position. He used his seniority to transfer to a less physically demanding mail room position. Subsequently, Barnett learned that two employees with greater seniority intended to bid for the mail room positions, which would displace him and force him back into a cargo role he could no longer perform. On August 31, 1992, Barnett requested to remain in the mail room as a reasonable accommodation under the Americans with Disabilities Act (ADA). U.S. Air did not provide a substantive response for five months, at which point it denied the request. Barnett then proposed two alternative accommodations: providing special lifting equipment for the cargo position or restructuring the cargo job to include only office work. U.S. Air rejected these proposals as well, informing Barnett only that he could bid on other jobs for which he had sufficient seniority and met the physical requirements. Barnett filed suit, alleging failure to accommodate and failure to engage in the interactive process. The district court granted summary judgment to U.S. Air on all claims.
