Barcamerica International USA Trust held an incontestable federal trademark registration for “Leonardo Da Vinci” for wine. In 1988 and 1989, Barcamerica entered into licensing agreements granting Renaissance Vineyards the exclusive right to use the mark in the United States. Neither agreement contained any provision for quality control. Barcamerica’s principal, George Barca, claimed he exercised control through occasional, informal wine tastings and by relying on the reputation of Renaissance’s original winemaker, who was now deceased. Renaissance, however, stated that Barca had no involvement whatsoever in quality control. Meanwhile, Tyfield Importers began importing and extensively marketing wine from an Italian producer, Cantine, which had used the “Leonardo Da Vinci” name since 1972. After Cantine initiated a PTO proceeding to cancel Barcamerica’s mark for abandonment, Barcamerica sued Tyfield for infringement. Tyfield moved for summary judgment, arguing Barcamerica had abandoned the mark through naked licensing.
